東南亞友好合作條約

《東南亞友好合作條約》（英語：Treaty of Amity and Cooperation in Southeast Asia，縮寫TAC），是由東南亞國家聯盟主導的、體現了東南亞各國和永久和平、友好合作的普遍原則的、提供東南亞地區及其他地區國家間關係的具有法律約束力準則的條約。[1]

《東南亞友好合作條約》由東南亞國家聯盟發起國於1976年2月24日在印度尼西亞峇里島舉行的東盟第一次首腦會議上簽署，最初有印度尼西亞、馬來西亞、新加坡、菲律賓和泰國5個簽約國，東盟其他成員國後續在1995年7月27日前都加入了《條約》。《條約》於1987年、1998年、2010年進行了三次修訂。截至2023年7月，《東南亞友好合作條約》有 51 個締約方。[1][2]

1987年修改的條約中，東盟邀請東南亞地區以外國家加入《條約》，以便建立信心、促進和平與安全，並推動地區繁榮。[3]1989年7月6日，巴布亞新幾內亞加入《條約》，成為第一個加入該條約的東南亞以外國家。[2]

2003年10月，中國-東盟首腦會議在峇里島召開。會議期間中國與東盟組織和各國高官共同舉行了中國加入《東南亞友好合作條約》的儀式，並將彼此關係升格為「面向和平與繁榮的戰略夥伴關係」。中國成為第一個加入《條約》的東南亞以外大國。當時的東盟國家和國際輿論給予積極評價，認為此舉夯實了中國—東盟互利合作的國際法基礎，使得雙邊關係更加制度化、法律化，增進了彼此關係的穩定性與連續性，有利於和平解決中國與東盟國家間的各類爭端，同時體現了中國更深融入經濟全球化進程並在地區和國際事務中發揮建設性作用的決心和行動，有助於加快地區經濟一體化進程，培育新的東亞國際體系。[2]

2009年7月22日，美國國務卿希拉里·羅德姆·克林頓簽署美國加入《東南亞友好合作條約》協議書（Instrument of Accession to the Treaty of Amity and Cooperation）。與此同時，東盟十個國家的外交部長簽署擴大《東南亞友好合作條約》協議書，（Instrument of Extension of the Treaty of Amity and Cooperation in Southeast Asia），完成美國入約程序。 美國加入《條約》的行動是美國希望與東盟在區域和全球重大事務中進行更深入和更有效接觸的象徵。[3]
